1. General

1.1 These general terms and conditions apply to all offers, orders and agreements at Denkadog.nl.

2. Application

2.1 These general terms and conditions apply to all legal relationships in which Denkadog.nl acts as a supplier of products.

2.2 Accepting an offer or placing an order implies that you accept the applicability of these conditions.

3. Offers

3.1 Offers are made subject to the availability of the products. Denkadog.nl can terminate the agreement. Typographical and printing errors remain reserved at all times.

3.2 Denkadog.nl expressly reserves the right to change prices, in particular when necessary based on (legal) regulations. See also article 5.3.

3.3 After the closing date of an offer or a promotional period has passed, the buyer cannot make use of the relevant promotion or offer.

4. Agreement

4.1 The purchase agreement between Denkadog.nl and the buyer is concluded at the moment that the inspection period of 7 working days after receipt of the order has expired.

4.2 An agreement is only concluded after acceptance of your order by Denkadog.nl. Denkadog.nl is entitled to refuse orders or to attach certain conditions to the delivery, unless expressly stated otherwise. If an order is not accepted, Denkadog.nl will notify this within ten (10) working days after receipt of the order.

5. Price and delivery

5.1 All prices are inclusive of Dutch sales tax unless otherwise agreed, exclusive of other levies imposed by the government, as well as any costs to be incurred under the agreement, including shipping, storage and/or administration costs. If the buyer is not located in the country of shipment, the buyer is liable for any sales tax or import duties due.

5.2 Prices include standard packaging and exclude freight costs, unless otherwise agreed.

5.3 If the prices for the offered products and services increase during the period of the order and its execution, you are entitled to cancel the order or terminate the agreement within ten (10) days after notification of the price increase by Denkadog.nl.

5.4 Denkadog.nl cannot be held liable for deviations in prices, images and texts.

5.5 Deliveries are EXW (ex works/point of sale/warehouse; Incoterms 2000), unless otherwise agreed.

5.6 Denkadog.nl reserves the right to deliver the items in more than one shipment.

5.7 Denkadog.nl will deliver orders to the specified delivery address or a post office nearby within five (5) working days after order confirmation, provided that the order is in stock and has been paid for.

5.8 The above delivery times are indicative and not a fatal term. Denkadog.nl is never liable for damage resulting from exceeding delivery times. The maximum delivery time will be 30 days unless otherwise agreed.

5.9 Denkadog.nl will ensure delivery by post or shipment in any other manner chosen by Denkadog.nl.

5.10 Ownership of products is transferred to the buyer upon delivery if the products have been paid for.

5.11 The buyer is obliged to accept the purchased items at the moment they are made available to him or are handed over to him, if the buyer refuses to accept them or is negligent in providing information or instructions necessary for the delivery, the products intended for delivery will be stored at the buyer's risk after Denkadog.nl has notified him. In that case, the buyer will owe all additional costs.

6. Intellectual and Industrial Property Rights

6.1 You must fully and unconditionally respect all intellectual and industrial property rights that rest on the products supplied by Denkadog.nl.

6.2 Denkadog.nl does not guarantee that the products delivered to you do not infringe any (unwritten) intellectual and/or industrial property rights of third parties.

6.3 All intellectual property rights relating to the Denkadog.nl site, including the software, texts, images and sounds, are owned by Denkadog.nl and/or by those from whom we have obtained a license. This means, among other things, that it is not permitted to publish, reproduce and/or edit the information stated on Denkadog.nl sites without our permission, except for personal use.

7. Shipping costs products

7.1 All prices of the products on the Denkadog.nl websites are exclusive of shipping costs (at applicable rates).

8. Secure payment

8.1 Pay for products according to the applicable payment method.

9. Return products

9.1 Products purchased via Denkadog.nl can be returned within fourteen (14) working days after receipt, stating reasons, provided that the purchase has not been used and is in the original packaging. The buyer can revoke his order within fourteen (14) working days after ordering, without having to pay a fine and without stating reasons. Provided that sufficient postage is paid. The buyer then also has the option to have the order amount, if already paid, refunded. To do this, you must contact info@ippinterpet.nl within fourteen (14) working days after receipt at the delivery address.

9.2 If you have received a product with a defect, Denkadog.nl will exchange it free of charge for exactly the same product, provided that the purchase has not been used and is in the original packaging, unless this product is no longer in stock or "end of life". To do this, you must contact info@ippinterpet.nl within seven (7) working days after receipt at the delivery address.

9.3 If you have received a different product instead of the ordered product, Denkadog.nl will exchange it free of charge for the product you ordered, provided that the purchase has not been used and is in the original packaging. The buyer is entitled to a refund of the order amount, provided that it has already been paid. To do so, you must contact info@ippinterpet.nl within seven (7) working days after receipt at the delivery address.

9.4 If any product may be returned under the above, the amount paid by you will be deposited into your bank or giro account within fourteen (14) days. You should always contact info@ippinterpet.nl about this.

9.5 If the above terms are not respected by the buyer, the above rights of the buyer shall lapse upon expiry of that term.

10. Complaints, investigation obligation, limitation period and compliance

10.1 Complaints regarding non-receipt of the order must be made within seven (7) days of receipt of the invoice, otherwise the correctness of the invoice will be established.

10.2 Complaints regarding defects in the products must be made in writing as soon as possible, but no later than seven (7) working days after receipt at the delivery address or – in the case of invisible defects – within twenty-one (21) days after the defects could reasonably have been discovered.

10.3 You are obliged to examine upon delivery whether the products correspond to the agreement. If this is not the case, you must notify Denkadog.nl of this as soon as possible and in any case within seven (7) days after delivery, or after the discovery could reasonably have been made, in writing and with reasons. If it is demonstrated that the products do not correspond to the agreement, you have the choice to have the products in question replaced by new products upon return or to have the invoice value refunded. If you do not wish to accept a product for whatever reason, you have the right to return the product to Denkadog.nl within seven (7) days after delivery. Returns will only be accepted in this case if the product is undamaged, and the costs for returns will also be at your expense.

11. Liability

11.1 Denkadog.nl accepts no liability for damage resulting from or related to the performance of this agreement or the delivery of goods, except if and to the extent that the damage is caused by Denkadog.nl's own actions or omissions, is done either with the intention to cause such damage, or recklessly and with the knowledge that such damage would probably result from it.

12. Applicable law/competent court

12.1 Dutch law applies to all legal relationships between Denkadog.nl and the buyer.

12.2 All disputes that may arise as a result of this agreement or of subsequent agreements that may result from it, will be settled in accordance with the Regulations of the Netherlands Arbitration Institute or, if Denkadog.nl so chooses, the competent court of the place of residence or establishment of Denkadog.nl or the buyer. The procedure will be conducted in the Dutch language. The arbitral tribunal decides in accordance with the rules of law.

13. Dutch text prevails

13.1 The Dutch text of these general terms and conditions prevails over any translations thereof.

14. Personal data

14.1 Denkadog.nl complies with the legal requirements regarding the protection of personal data, as laid down in the Personal Data Protection Act.

14.2 Denkadog.nl will include the data provided by the buyer in a file. This data will be used for the execution of the buyer's order and will be stored for as long as necessary for the handling of any complaints following the execution of the order. No data will be provided to third parties where the privacy of the buyer is compromised.

15. Miscellaneous

15.1 If you provide Denkadog.nl with an address in writing, Denkadog.nl is entitled to send all orders to that address, unless you provide Denkadog.nl with another address in writing to which your orders should be sent. 15.2 If one or more of the provisions of these Terms and Conditions or any other agreement with Denkadog.nl are in conflict with any applicable legal provision, the provision in question will lapse and will be replaced by a new legally permissible comparable provision to be determined by Denkadog.nl.

16. Changes to general terms and conditions

16.1 These general terms and conditions may be amended or supplemented by Denkadog.nl at any time without notice or loss of any rights. The amendments will be announced on the websites of Denkadg.nl. The amendments will enter into force fourteen (14) days after announcement or on a later date stated in this announcement.
